我国检察一体保障制度的完善

Perfection of the Safeguarding System of Unification of Procuratorial Organs in China

检察一体保障功能体现为对依法独立公正行使检察权的保障。世界范围内的检察一体保障制度可分为外部保障模式和全面保障模式。目前我国检察一体保障制度存在外部保障较弱、内部保障较强的问题,应建立以外部保障为主、内部保障为辅的折衷保障模式,并从增强检察机关的整体独立性、完善检察机关之间的协作机制、有效规制上级指令权、确立检察官的办案主体地位等四个方面,完善我国检察一体保障制度。

The safeguarding function of the procuratorial organs embodies the role of safeguarding the procuratorial powers to be performed independently and justly in accordance with the law. The safeguarding function can be divided into two kinds of models: the external safeguarding model and the internal safeguarding model. At present,the external safeguard is rather weak but the internal safeguard is rather strong in the unification of procuratorial organs in China. We should establish a compromised model which bases on the external safeguard mainly with the supplementary internal safeguard,and perfect our safeguarding function of the unification of procuratorial organs from the following four aspects: strengthening the entire independence of the procuratorial organs,perfecting the cooperative mechanism among the procuratorial organs,regulating the commanding power of high levels effectively,and establishing the subject position of prosecutors in dealing with cases.
