摘要
僧人遗产继承纠纷问题由来已久,症结在于僧人遗产是否应当由其俗家亲属继承,在我国法律上并无特别规定,而按照佛教戒律和丛林清规,僧人遗产应归寺院(僧团)所有,从而产生宗教习惯与法律规定之间的冲突与僧俗两界的分歧,使司法实务操作陷入困境。解决冲突的有效办法是通过立法途径来实现,即通过进一步完善我国继承立法,强化僧侣遗产继承的司法保护,强化宗教习惯与教义仪轨的作用来解决僧人遗产继承法律问题。
Monks inheritance disputes have occurred in our daily lives.The sticking point of the problem lies in that monks legacy should be inherited either by relatives or abbeys,which cause conflict between religious customs and provisions of law so that judicial practice would be in trouble.The most effective solution to the dispute is to legislate.That is to say,by improving inheritance legislation to strengthen judicial protection and intensify religious customs and rituals we could find a method to solve legal issues of monks inheritance.
