摘要
情势变更原则在商品房买卖合同纠纷中适用一直是个疑难点。近年来,随着房地产市场调控政策的反复,以情势变更为由主张解除或变更合同的案例时有发生,比较典型的两种案例为:因政策原因买房人无法办理按揭贷款以及开发商因资金筹措困难、市政配套设施未到位等原因导致延期交房情形。文章探讨情势变更原则在这两类案件中的具体适用具有一定的现实意义。
How to apply the principle of substantial change of circumstances in the commodity house purchase and sales of contract disputes makes a problem of the law practice. In recent years,for the adjustment of national housing policy,the cases of claiming to cancel or change the contract,in which the principle of substantial change of circumstances has been quoted,is not rare. Two typical cases include:( 1) the customer is not able to get mortgage loan due to policy;( 2) the property developer postpones apartment delivery due to financial problem or inadequate public facility. It is of certain realistic significance.
