摘要
以法律形式保护民族文学作品不仅关乎特定群体、民族、国家的利益,也关系到民族文学艺术自身的创新发展。《著作权法》早在上世纪90年代就明确指出民族文学作品受法律保护,但相应的具体法律法规却至今未出台,重要原因之一就在于其法律保护模式选择存在困境。新的保护模式应当在现行知识产权制度的基础上,明确其权利主体和权利内容并加强与《非物质文化遗产保护法》、《著作权法》、《专利法》、《商标法》等的衔接,以特别法的形式进行专门保护和适度保护,维护民族文学作品来源群体的多元利益,同时促进对民族文学的弘扬和推广。
In the form of legal protection of folk literary and artistic works is not only related to a particular group,national interests,but also related to the innovation and development of folk literature and art itself."Copyright law"early in the 1990 s clearly pointed out that folk literary and artistic works are protected by law,but the corresponding specific laws and regulations, but has not yet been introduced, one of the important reasons is the legal protection mode selection dilemma of existence. The new protection mode shall,on the basis of the existing intellectual property system,clear the rights of the subject and content of rights and strengthen and the convergence of the intangible cultural heritage protection law,the copyright law,the patent law,"trademark law"and other,in the form of special law of special protection and appropriate protection and maintenance works of folk literature and art source groups of multiple interests and also promote to the folk literature art carry forward and promote.
