对我国制定宗教基本法之主张的检视

Examining the Claims of Legislating the Basic Law of Religion in China

我国并不存在一部统一的、综合性的宗教基本法,实践中的国家治理主要通过行政法规、规章等规范性法律文件及政策来进行,因此一直有人主张我国应当尽快制定宗教基本法。此观点虽颇为有力,但目前我国无制定宗教基本法之必要,立法条件亦尚未成熟;当务之急应当是继续解释、实施好已有的法律规范和政策,并可考虑先行制定《宗教团体法》。

There is no a basic law of religion in China and the national governance in religion field is based on some normative legal documents and policies principally. Therefore,quite a few people have been advocated to making a basic law of religion as soon as possible. Although this proposal is robust and powerful,it is not necessary and an appropriate timing for China to make a basic law of religion currently. We should reinforce laws which already exists,or make a religious group law at first.
