摘要
开放获取是指提供对科学知识的自由和不受限制的获取。在独占和排他著作权许可合同模式下,开放获取与传统著作权规则存在冲突。德国和荷兰的著作权法的修改,给予作者"二次公开权",即在首次发表之后,保留向公众无条件开放获取学术期刊作品的权利,并规定出版合同中限制二次公开权的条款无效。我国应当借鉴欧盟国家的著作权修改模式,建立公共资助学术期刊开放获取规则。
Open Access is a free and unrestricted access to scientific knowledge. Under the mode of exclusive and exclusive license contract, there is a conflict between Open Access and traditional copyright rules. Germany and the Netherlands modify the copyright law to give authors ＂second right of publicity＂, that is one year after the first publication, reserved the right of unconditional Open Access academic journals to the public, and indicates that publishing contracts are invalid in terms of the right to limit the second right of publicity. China should learn from EU countries copyright modifies mode, and establish the Open Access rules of public funded academic journal.
