摘要
近年来,在集体土地上建公租房的试点不断扩大,但这一做法不仅面临着《土地管理法》、《城市房地产管理法》的障碍,而且还有违反《宪法》的风险。因此,为推动集体土地上建公租房试点的顺利施行,不仅需要修改《土地管理法》,允许集体建设用地的流转,对集体土地所有权主体进行法人化改造,并以土地股份合作制作为集体土地所有制的实现方式,而且还需要对《宪法》第十条第一款做出新的解释,充分尊重农民意愿,明晰政府的住房保障职责。
In order to speed up the construction of public rental housing, some local governments start to try to build pub- lic rental housing on collective construction land. However, this practice not only violates the law of land administration of the people's republic of china and law of the people's republic of china on urban real estate administration, but also may violate the constitution of the people's republic of china. Therefore, for the sake of promoting the policy implemented smoothly, that builds public rental housing on collective construction land , we need to modify the law of land administration of the people's republic of china and allow the farmers to circulate the collective construction land. Meanwhile we ought to make the collective land ownership have corporate capacity, and then realize the collective land ownership by means of share cooperation system of rural land. After that, we have to reinterpret the Article 10, paragraph 1 of the constitution of the people's republic of china. Furthermore, it's also necessary to fully respect the wishes of farmers and clear the government's housing security responsibility.
