摘要
我国金融领域中分业监管与混业经营的体制、金融商品的复杂化与专业化等导致损害金融消费者权益的纠纷问题日益凸显,而我国法律并没有对金融消费者保护问题进行相关的规定。通过分析金融消费者产生的社会基础、理论基础以及立法对金融消费者保护的缺失来阐释界定金融消费者概念的必要性。由于对金融消费者概念的界定我国学术界存在不同的观点,因此将对存在的主要分歧进行探讨进而对其概念予以界定。
At present,the cases of damaging rights and interests of the financial consumers happen from time to time with financial products getting more complicated and specialized. Otherwise,another reason is the conflict that is between separated supervision and mixed operation. However,there are neither laws and regulations that define the meaning of the financial consumers definitely nor the law system that focuses on protecting the financial consumers. Analyzing the social basis of the financial consumers,the theoretical basis of the financial consumers and the legislation flaws in protecting financial consumers illustrate the necessity of defining financial consumers. However,there are many different comments in our academic circle about the definition of financial customers. The article will discuss the main disagreements to define the meaning of financial customers.
