我国环境服务业法治化之路径研究

Legalization Path of Environmental Services in China

我国环境服务市场具有非常大的市场潜力,但由于环境问题执法不严、信息公开不透明、市场竞争不充分、合同环境服务模式不确定、环保金融投资匮乏的影响,环境服务业的庞大市场潜力并没有转化为现实的需求。环境服务业市场化、专业化、社会化亟需法治化给予保障。通过探索研究环境服务业法治化发展,分析目前我国环境服务行业现实困境,参考国际环境服务市场状况,借鉴域外法律规范经验,寻求一条适合中国特色的环境服务业法治化发展道路。

The environmental service industry in China is still in developing stage,and it has great market potential. However,the huge market potential for environmental services is not transformed into realistic market demand due to the laxity in environmental law enforcement,opacity on information disclosure,insufficiency in market competition,the uncertainty of environmental services contract model and the shortage of environmental financial investment. There is an urgent need for legalization to guarantee the marketization,specialization and socialization of environmental service industry. Through exploring the development of environmental service industry＇s legalization,this paper analyzes the industry dilemma in China,taking international environment and market conditions as reference and learning from foreign experience in legal norms,then seeks a suitable development road for environmental services＇ legalization with Chinese characteristics.
