土地征收过程中的土地行政伦理失范探析

The Anomie of Land Administrative Ethics in the Process of Land Expropriation

在快速城镇化进程中,我国土地征收制度暴露出弊端,其实质原因是伦理价值的缺失。在已有研究的基础之上,从土地行政伦理的公共服务和人地和谐的基本价值导向看土地征收过程发现,土地征收的过程存在着行政伦理和土地伦理失范的现象。其中行政伦理失范表现为行政公平缺失、社会正义沦陷、政府角色混乱、行政责任淡薄和公共承诺失效。土地伦理失范表现为因土地伦理适用性前提不完整而导致的土地生育功能被剥夺、土地价值被片面化和土地资源浪费严重。

During the rapid growth of urbanization,China′s land expropriation system has exposed problems,which internal reason is the lack of ethical values.Based on the previous studies,this paper analyzed the process of land expropriation according to the basic value orientation of the land administrative ethics,including public service and harmonious between man and earth.The finding showed the loss of administrative ethics and land ethics in the process of land administrative in China.Abnormal administrative ethics manifests as absence of administrative fairness,losing of the social justice,role confusion of officers,weak sense of public responsibility,and invalid public commitment.Abnormal land ethics manifests as the deprivation of land reproductive function,land value undervaluation,and the waste of land resources.
