论新媒体与传统媒体的合作共赢——从“今日头条”版权纠纷说起

网络环境下,乱载滥刊行为十分普遍。一方面,传统媒体辛苦采编却在不断丧失市场;另一方面,新媒体却做得风生水起。新技术发展,显示了新媒体与传统媒体之间的激烈冲突。类似"今日头条"的行为模式涉嫌不正当竞争,而如何实现新媒体与传统媒体的合作共赢是亟待解决的问题。立法应明确"时事新闻"的含义,加强网络版权执法,发挥集体管理组织与行业协会的作用,净化版权保护的网络环境,促进新闻产业快速健康发展。

Under the network environment,free reprint behavior is widespread. On the one hand,traditional media hard editing but constantly losing market; on the other hand,the new media is very prosperous. With the development of new technologies,intense conflict between new media and traditional media continues to heat up. Today＇s headlines similar pattern of behavior alleged unfair competition,and how to achieve win-win cooperation of new media and traditional media is a serious problem. We need to clearify the meaning of ＂news＂in the legislation,to strengthen the network of copyright enforcement,to play the role well of collective management organizations and trade associations,to purify the internet environment of copyright protect,promoting the development of the news industry rapid and healthy.
