摘要
离婚后的扶养制度在我国以《婚姻法》第42条为核心,以最高人民法院司法解释的有关规定为补充,已经形成了较为完备的体系,但其仍有不足之处。我国应通过借鉴其他国家关于离婚扶养制度的规定,对我国离婚抚养制度予以完善。
In our country the maintenance after the divorce system has formed a relatively complete system,which is taking the article 42 in Marriage Law as the core,with the relevant provisions of the supreme people＇s court judicial interpretation as the supplement. But it still has shortcomings. Our country should draw lessons from other countries through the regulation about divorce maintenance system,raising the divorce system of China more perfect.
