摘要
基于"禁止拒绝裁判"原则,法官有权对存在法律适用困难的案件作出漏洞填补式的处理,而法律原则的适用便是填补法律漏洞的重要方法。本文在对法律漏洞作类型化概述后,以存在"原则漏洞"的"四川泸州继承案"为切入点,就法律原则"补缺作用"的启动机制与运行机理进行了分析。
According to the principle of forbidding rejecting judging,judge owns the power to make decisions via having access to legal principles in some cases which have difficulities in researching specific and adequate norms and establishing the connection between cases and norms as a result of the existence of legal loopholes. This essay firstly summarized the types of legal loopholes,then analyzed the trigger mechansim and operational approach of legal principles.
