社区矫正裁前评估是决策机关适用社区矫正的量刑要件和程序,对于管理社区矫正人员具有重要意义。该制度在实践中面临很多问题,首先是在全国范围内缺乏统一规范,使得制度不健全;其次是基层司法所人员配置不足,裁前评估对象跨省难开展。为了完善社区矫正裁前评估制度,应该在法律法规上确立适用裁前评估制度;加强裁前评估制度的法律宣传,树立责任意识;加强基层队伍建设,落实经费保障;完善外省籍矫正人员的评估机制。

Evaluation for community correction before the ruling authority reaches the verdict is an essential for sentencing as well as a necessary procedure for applying community correction. Despite its vital importance in managing the offenders under community correction, this system encounters lots of trouble in practice： the system remains imperfect owing to the lack of nationwide unified regulations; the grassroots judicial offices can＇t afford adequate staff to conduct trans-province evaluation before reaching a verdict. In order to improve the evaluation system for community correction before the verdict, the following measures are necessary： to confirm the application of this system in forms of law or regulation; to strengthen the law propaganda; to establish a sense of responsibility; to reinforce the construction of grassroots working staff and ensure sufficient funds; to improve the evaluation mechanism for the offenders from other provinces.
