The Operating Mechanism of Legal Affairs Office in Capital Cities and Reform Directions in the Rule-by-Law Context

法制办公室作为各级政府负责法治建设的工作机构的职能似乎是显而易见的,但由于其长期以来角色定位的"内部性",其在具体的政治-法律实践中的运行机制又显得模糊不清。都会城市法制办因其所处复杂的政治生态和交错的权力场域尤其如此。在十八届四中全会对法制办的工作提出新要求的宏观背景下,应该在准确揭示都会城市法制办运行机制的基础上,结合依法治国的新要求,提出符合都会城市特点的改革进路。提高法制办的地位,转变职能,充分发挥基本政府决策和信息公开等方面的作用。

The Office of Legal Affairs at all levels of governments being responsible for the construction of the rule-by-law institutions seems obvious. But because of its ＂internal＂ role for a long time, its political-legal practice in the specific operation mechanism appears blurred and indistinct. The Office of Legal Affairs in capital cities is particularly in such a situation because of the complex political environment with crisscross fields of power. With new requirements for the work of legal affairs office put forward at the 4th plenary session of the 11th Central Committee of CPC, reform should be carried out based on a scientific study of the operation mechanism of legal affairs office. We should take into account the characteristics of capital cities, and, by raising the status of legal affairs office and changing its functions, we can make full use of the role of legal affairs office in basic decision making and information publication.
