比较法视野下的行政立法监督——兼谈我国的制度选择

On the Supervision of Administrative Legislation from the Perspective of Comparative Law

行政立法的监督,各国采取了不同模式,英国的议会监督、法国的行政法院监督以及美国的行政监督各具特色,但都很好地承担起了各国主要的监督任务,究其原因在于这些制度根植于本国历史,切合本国国情。参考比较法的经验并总结我国的实践,美国的做法更具借鉴意义,我国应该着力将行政立法的行政监督建设成为监督主渠道,同时逐步完善其他监督制度。

Different countries take different forms of the supervision of administrative legislation. The Parliament supervision in England, the administrative court supervision in France and the administrative supervision in USA have their own features. The reason why these systems undertake well the supervisory task is that they root in their history and suit for their own national conditions. By using the result of comparative law and summarizing China＇s experiences, China should learn from the model of USA and should concentrate on forging the administrative supervision of administrative legislation as the major supervisory approach, and at the same time improve other ways gradually.
