政策与法律之间存在着良性互动的关系,这可以我国计划生育事业的历史进程为证。两者的良性互动,有法政策学和行政过程论做理论基础,但是,两者的互动也存有功能上的障碍,为了更好的实现两者的互动,公众参与原则和法治思维原则,是必须坚持贯彻实施的。

The historical process of Chinese family planning witnesses the benign interaction between policy and law. Law policy study and administrative process theory being the theoretical basis, the interaction between the two still has some barriers. In order to achieve a better interaction, we must adhere to the principle of public participation and the rule of law thinking.
