司法规范新常态下刑事案件运行的法律治理——基于2014年X市W区检察院刑事案件的实证分析

Legal Governance of Criminal Case Operation under the New Normal Background of Judicial Norms——Empirical Analysis Based on Criminal Cases of the People's Procuratorate in W District of X City in 2014

司法规范化是理论界和实务界高度关注的现实问题。刑事案件的运行状况直接关系到司法规范化的现实效果。刑事案件的运行亦是司法规范的一个缩影,折射出社会危险性调查取证不足、犯罪嫌疑人的羁押率过高、侦查主导性与检警关系的质疑以及强制措施刑罚化的法律问题。基于当下刑事案件运行的实证考量,提出逮捕必要性深度化、侦查监督职能化与强制措施区分化的法律治理方案。

The judicial standardization is available to find current dilemma to be focused on majorly from theory and practice. The operation in criminal cases relates to the real effect of judicial standardization directly. It is also a miniature of judicial standardization,reflecting legal problems such as inadequate collection of investigation and evidence about social risk,high-rate custody of criminal suspects,the question of the relationship between the investigation-leading and the prosecution and the police,and criminal punishment penalization. Based on the current reality of operation in criminal case,it is suggested that the depth of arrest necessity be enlarged,the investigation supervision functionalized and the compulsory measures differentiated.
