摘要
我国自20世纪90年代开始启动排污许可工作。由于历史局限,水污染物、大气污染物、固体废物等排放许可分别进行,又与环评、总量控制等制度存在交叉。当前推行综合性的排污许可制度面临环保系统内部的体制性障碍。发达国家施行的排污许可制度均为综合性的环境许可制度。当下我国为实现提高环境质量的目标,应当实施综合性的排放许可制度。为此,要科学整合排污许可制度与环评、总量控制等制度的关系,并将这些制度纳入法制轨道。当务之急是推进体制改革并制定统一的《排污许可法》。
China' s Environmental Permit System originated in the 1990s. Due to historical limitations, discharge of water pollutants, air pollutants and solid wastes were separately licensed, and the licensing system overlapped with systems like Environmental Impact Assessment (EIA) and Total Pollutant Control. Thus, currently, the establishment of a comprehensive Environmental Permit System is confronted with the mechanism barrier from the environmental protection system itself. The Permit System implemented in developed countries is a comprehensive system. China should also establish a comprehensive Permit System in order to achieve the goal of improving the environmental quality. Thus, we should integrate the current permit system with the systems of environmental impact assessment and total pollutant control, and legalize them. It is imperative to accelerate the structural reform and formulate a unified Environmental Permit Law.
