对依法治警中外部行政干预的思考

Thinking about External Administrative Intervention in Managing Police by Law

党的十八大确立了依法治国,建设法治国家的基本任务,依法治警则是依法治国的必然逻辑与选择,也是社会发展的必然要求与警务发展和改革的必然趋势,自1992年7月公安部政治部在《关于实施〈中华人民共和国人民警察警衔条例〉的宣传提纲》中提出依法治警以来,我们在依法治警的改革过程中,大多是在追求对公安机关及人民警察的管理和要求,却少有从系统性与整体性的角度思考依法治警的内部和外部的影响与制约因素。本文从依法治警的外部环境之外部行政干预的角度进行思考。

The 18 th National Congress of the CPC has established the basic task of Governing state by law and building a state with an adequate legal system. Managing Police by Law is inevitable logic and selection in governing state by Law, and inevitable claim in society development, and inevitable trend in police development and reform. In July 1992, Political department of ministry of public security proposed managing police by law in the publicity outline of implementing the People＇s Republic of China People＇s Police Regulations. From then on, In the process of reform of managing police by law, Management and requirements on public security organs and people＇s police was much more emphasized than consideration on Internal and external influences and constraints in managing police by law from the point of view of system and integrity. This paper thinks deeply about external administrative intervention in managing police by law.
