Don't be an Alien to Cultures: The Predicament of Study on Chinese Traditional Legal Thoughts and the Way Out

通过作为"他者"的西方法律文化的扩张和作为主体的中国法律史研究的偏离等方面的剖析,以期找到法律史研究中"自我"与"他者"的平衡。探求中国传统法律文化的真知,从精神上疏远"自我"以及以宽容之心接受"他者"均是必要的条件,只有在"疏远"与"亲近"之间达到同样的协调和均衡时,才能对"自我"以及作为异质文化的"他者"做出合理的判断。在对中国传统法律思想进行研究时,我们不仅要"得古人之言",更为重要的是"得古人之心"。对不同的法律文化进行"历史分析"和"文化诠释"才是我们法史学研究得以正确进行的必要前提。

This paper analyzes the expansion of ＂ alien＂ western legal culture and the departure of study on Chinese legal history and tries to find a balance between ＂ self＂ and ＂ alien＂. We shall seek the truth from Chinese traditional legal culture,spiritually drift apart from ＂ self＂ and accept ＂ alien＂ with much tolerance. Only when we reach a balance between ＂ departure＂ and ＂ intimacy＂ can we give a rational judgment to ＂ self＂ and ＂ alien＂ cultures. In the study of Chinese traditional legal thoughts,we not only need to know what ancient people say but also know what ancient people mean. Making a historical analysis and cultural interpretation to different legal cultures is the necessary prerequisite for Chinese legal history study to be properly carried out.
