论规避技术保护措施的刑法规制

技术保护措施是版权人为维护自身合法权益所采取的技术性手段,对保护作品、维护版权人正当权益具有重大意义。随着技术的不断发展,规避技术保护措施的行为频繁发生,给版权人合法权益造成了重大损害,亟需规制。鉴于民事、行政救济手段在规制规避技术保护措施行为方面的缺陷,我国刑法有必要为规制规避技术保护措施行为作出制度安排,具体思路为在刑法中增加规避技术保护措施罪。
