公共治理视阈下社会安全事件赔偿与救助主体研究

Research on the Social Security Incident Compensation and Assistance Subject under the Perspective of Public Governance

由于国际极端主义的兴起和我国经济发展的不均衡,我国社会安全事件时有发生。社会安全事件发生后需要对受害者进行赔偿和社会救助,但是,由于肇事者大多无民事赔偿能力,受害者无法得到应有的赔偿。社会安全事件的发生是多种原因共同作用产生的,不仅肇事者个人要承担主要责任,同时,中央政府和地方政府也要承担客观责任。中央和地方政府有社会安全事件的赔偿责任和义务,是社会安全事件的责任和赔偿主体之一。社会安全事件社会救助作为赔偿的辅助工作,各级政府、慈善机构、爱心人士和企业都应该是社会救助的主体,在救助工作中发挥各自优势互相配合,保障社会安全事件受害者的合法权益。

Due to the rise of international extremism and China＇s economic development imbalance, social security incidents have often occurred in China. After social security incidents happen, victims need to be compensated and given social assistance. However, since most of the perpetrators have no capacity for civil compensation, the victims can not be compensated. The happening of social security incidents is caused by many reasons, so not only individual perpetrators should bear the primary responsibility, but also the central and local governments have to bear objective responsibility. Central and local governments have the responsibility and obligation to compensate social security incidents and they are one of the subjects of social security liability and compensation in the event. Social assistance as compensation auxiliary work in social security incidents, governments at all levels, charities, caring people and businesses should be the subject of social assistance. Various departments play their respective advantages in the rescue work so as to protect the legitimate rights and interests of victims in social security incidents.
