从“人治”时期到“后生态化”设想——中国能源法制发展回顾及预判

From “Rule of Man”To “Post-ecological”——A Review and Prejudgment of the Development Process of China's Energy Legal System

部分学者认为我国能源法制发展仅30余年,不可谈史。但"法制"不等于"法律",在"法制"及由此衍生的"法制史"语境中,能源法制发展远不止几十年。应当以更广阔的视角审视分析我国能源法制的发展进程,总体上看可以分为:"人治"时期能源法制孕育阶段;能源法制"立法起步——活跃"阶段;能源法制与环境法制趋近阶段;"后生态化"阶段等四个阶段。前三阶段为我国能源法制建设提供了传统渊源基础;第四阶段则是基于前三阶段的预判,以为能源法制发展方向提供参考。

It is generally accepted that the history of Chinese energy legal system development is short,it＇s only about 30 years. However,legal system is not the same as legislation,the development of the whole energy legal system goes through more than decades in the context of ＂legal system＂and the history of legal system derived from ＂legal system＂. We should analyze the development process of Chinese energy legal system from a broader perspective,thus the development process of Chinese energy legal system can be divided into four stages： infancy period under＂rule of man＂,start-active period,approaching stage of energy legal system and environmental legal system and post-ecological period. The research on the first three stages provides native support for Chinese energy legal system construction and the fourth stage is the prejudgment based on the first three stages which offers a possibility for further research on the development direction of Chinese energy legal system.
