中国特色民生法治化的建构逻辑与路径

The Study on the Construction Logics and Paths of Rule of Law in People's Livelihood with Chinese Features

用法治保障和改善民生是社会的普遍共识,建设和发展中国特色社会主义民生事业必须强化法治的功能和作用。民生的实践品格及权利属性是民生法治化的逻辑基础,全面推进依法治国的重点和关键是推进民生法治化。我国民生法治化建设取得了重大进展,但发展与问题并存的客观现实依然存在。切实改变民生法治建设滞后的面貌,需要加强民生法制体系建设的总体谋划和顶层设计,从民生立法、民生法治服务、民生法治实施等维度构建系统化的、科学化的、符合中国国情而又具有中国特色的民生法治化体系,为保障和改善民生提供完备的法治保障。

To safeguard and improve people＇s livelihood with the rule of law is a common practice in mature societies. The development of people＇s livelihood with Chinese characteristics must emphasize the function of the rule of law. The practical character of the cause of people＇s livelihood and its rights property is the logical foundation of promoting rule of law for the undertaking of people＇s livelihood, which is the key of promoting the rule of law in China. Significant progress has been made in promoting rule of law for the undertaking of people＇s livelihood, but the reality of coexisting progress and problems haven＇t been changed. To improve the situation of poor legislation in the undertaking of people＇s livelihood, China needs to take a special path to promote rule of law in the area of people＇s livelihood, strengthen the overall planning and top design for building the legal system of people＇s livelihood, so as to build a systematic and scientific system of rule of law with Chinese characteristics in the area of people＇s livelihood, from the perspectives of legislation, legal service, and implementation. Thus providing legal guarantee for ensuring and improving people＇s livelihood.
