摘要
为了维护在校学生的人权,创造安全的学习环境,瑞典通过立法确立了中小学校预防和规制校园欺凌的责任,要求教育机构制订预防校园欺凌相关计划,并对计划的实施进行评估。因校园欺凌引发损害时,受害者可通过诉讼请求学校进行损害赔偿。我国目前校园欺凌现象较为严重,但缺乏立法和相关对策,因此,有必要借鉴瑞典的立法和经验建立我国的相关制度。
In order to maintain students＇ human rights for a safe learning environment,Sweden has established the responsibility of school by the legislative way,trying to ban school bullying phenomenon.Therefore,education institutions should make plans and evaluate the implementation of the plans.If students are bullied and damaged by others,they have the right to request the school to compensate by way of lawsuit.In present China,bullying phenomenon is not uncommon,but we are lacking in corresponding laws and countermeasures.Thus,we might draw lessons from the Swedish legislation and experience to establish China＇s relevant systems.
