论宪法实施的现实困境与应对之策

The Realistic Dilemma and Countermeasures of the implementation of the Constitution

众所周知,宪法是我国的根本大法,但宪法实施的状况令人堪忧。目前我国宪法的实施面临三方面的问题:一是宪法条文实施现状堪忧;二是宪法解释机制尚未启动;三是宪法监督制度亟需健全。因此,结合实际,应从以下三方面予以应对:一是培养宪法共识,奠定宪法实施的文化基础;二是加快宪法解释的常态化和制度化,这是宪法实施的重要前提;三是建立健全宪法监督机制,这是宪法实施的最佳出路。总之,中国宪法只有走向实践,并发挥其应有的功效,中国特色社会主义法治国家的未来才值得期待。

As it is known to all,the Constitution is the fundermental law of our country; however,the implementation of the Constitution is very awful. There are mainly three problems on carrying out the Constitution. First,the implementation of the Constitution is worrying. Second,the explanation facility of the Constitution has not been promoted yet. Third,the supervied facility should be improved. Basing on the actual situation,this paper provides three coping strategies. Firstly,we should cultivate the common view of carrying out the Constitution and establish the culture foundation,then speed up to normalize and instituilaze the explanation facility of the Constitution. Finally,establishing and perfecting the supervised facility is the most important way to carry out the Constitution. To summarize,the Chinese Constitution should be down to earth and give full play of its efficacy. Only in such way,the legal society of the Chinese characteristic socialism will be worth expecting.
