摘要
伴随着网络技术的蓬勃发展,电子商务已成为一种新兴的商业模式。由于网购的虚拟特性以及现行管理制度、维权机制的缺失,消费者权益受损案件时有发生。网购消费者后悔权制度通过赋予网购用户无条件解除合同的权利,来充分保障网购用户的购物自由。新《消费者权益保护法》规定的后悔权,顺应了消费者的诉求和愿望,为消费者进行维权提供了法律武器。通过对普通消费者后悔权与网购消费者后悔权的本质与特性的分析,就后悔权制度在适用实践中存在的一些问题和争议提出立法建议。
With the rapid development of internet technology,electronic commerce has been a new business model.Because of the virtuality of online shopping and the deficiency of the current management system and the rights protection mechanism,the disputes of consumers rights and interests often arise.The consumers' regret right regulated in the newConsumers' Rights and Interests Protection Lawconforms the demand of consumers and provides them with legal weapon for rights protection.This paper put forwards legislative proposals to the problems and disputes in the application of regret right system by the analysis on the essence and characteristics of consumers' regret right and consumers' regret right in online shopping.
