死缓制度是中国特色刑罚制度的重要体现,其设立的宗旨就在于既保留死刑的威慑力,又能在最大限度上限制、减少死刑的实际适用。在当代中国死刑改革的大背景下,死缓制度较好地体现了当前"保留死刑,严格控制和慎重适用死刑"的死刑政策,契合了国际社会限制与废止死刑的潮流,更新了民众的死刑观念,为逐步废除死刑打下民意基础。然而,由于立法的缺陷和不足,极大地限制了死缓制度的功能发挥。因此应厘清当代中国死刑改革背景下死缓制度的现实价值,探讨现有制度的结构性缺陷,并对现有制度进行有目的的立法改进,以期使其效能发挥至最大,为最终废除死刑提供一个现实的制度缓冲。

Death penalty with reprieve system is an important inflection of Chinese special criminal penalty system with the aim of staying the deterrence of death penalty as well as limiting and decreasing the actual practice of death penalty to the largest extent. Under the background of death penalty reform in modern China,death penalty with reprieve system preferably reflects our death penalty policy,namely ＂Keep death penalty while control it strictly and apply it prudently＂,which is in accordance with international trend of death penalty limitation and abolishment,renews people＇s views on death penalty and reaches the base of the gradual abolishment of death penalty among people. However,because of the drawbacks and deficiencies of the legislation,the death penalty with reprieve system has been extremely limited to function. This essay is trying to figure out the realistic value of death penalty with reprieve system under the background of current Chinese death penalty reform,to analyze its structural deficiencies and to make purposeful legislative improvement on the current system,in order to function efficiently to the largest extent and provide a systematic and realistic cushion to the final abolishment of death penalty.
