《人民武装警察法》的立法缺失与完善

Deficiency and Improvement of legislation for the People＇s Armed Police Law

《人民武装警察法》自颁布施行以来，为武警部队有效执行安全保卫任务提供了法律保障。但在实际操作过程中，还存在立法依据不明确、法律名称与适用范围不对称、组织领导和管理权限不具体、保障措施不完善、与其他法律规范的衔接不一致等立法缺失。通过梳理人民武装警察法立法背景的基础，提出增加《宪法》《国防法》等立法依据，充实相关法律内容或调整法律名称使内容与标题进一步匹配，明确武警部队的具体领导和管理权限，细化保障内容和配套措施，归纳整合现存的法规制度以形成体系，使其更具权威性、严谨性和统一性。

Since the People＇s Armed Police Law was enacted,it provides effective legal protec- tion for security tasks. But in the process of actual operation, the basis of the legislation is not clear. The law and the applicable scope are not coherent, and organization, leadership and management rights not specific. The safeguard measures are imperfect and the connec- tion with other legal norms are not efficient. After integrating the legislative background of the People＇s Armed Police Force Law, the paper proposes that there is a need to add the Con- stitution,National Defense Law and other legislative basis, enrich related legal content or revise the legal name in order to make the content match with its title more appropriately, explain explicitly the leadership and management authority of the People＇s Armed Police, re- fine the security content and supporting measures, and integrate the existing laws and poli- cies so as to constitute a system, thus making it more authoritative, precise and concordant.
