非公有制经济发展法治环境的现状与优化

Status Quo and Optimization of Legal Environment to Support Non-public Economy

劳动力、资本和法治环境是制约非公有制经济发展的重要因素。当前制约非公有制经济发展的,主要是政策、法律和软环境。近年来,已经出台了一系列旨在鼓励、支持和引导非公有制经济发展的法律政策。然而,在现有法律框架内,还存在市场准入不平等、融资难、税负过重、政府职能错位及知识产权意识淡薄等问题,制约了非公有制经济的持续发展。应改善法治环境,给予非公有制企业市场准入平等待遇、推进财税体制改革、加大金融支持力度、促进政府职能转变以及培育知识产权法律服务体系,促进非公有制经济发展方式转变。

The development of non-public economy relies on fair legal environment, adequate capital and labor force. The status quo of economic policies, laws and regulations, and intangible infrastructure has restrained a healthy growth of non-public economy. Although a tremendous amount of improvements have been made in the past years, there are still inequities of market access, financing difficulties, heavy taxes, government malfunctions, and neglect of intellectual property rights in the current law system. These issues have significantly compromised the sustainable growth of non-public economy. The present study proposes a series of effective measures to address these issues：improving current legal environment; providing equal opportunities for market access; reforming financial and taxation systems; enhancing financial support; transforming government functions; establishing legal service system for intellectual property rights and changing development mode of non-public economy.
