论城市治理PPP模式中行政决策失误责任追究

Administrative Decision-Making Error Accountability on the PPP Model of Urban Governance

根据治理理论,城市治理PPP模式可以实现多元主体参与城市治理,从而有效解决"公用地悲剧"现象。城市治理PPP模式涉及政府利用行政职权的行政部分存在行政决策失误责任追究制度。确定行政决策失误是追究行政决策失误责任的前提,对行政决策失误的评估应当围绕三个要件:决策失误行为要件、损失重大结果要件以及因果关系要件。其中,对于决策失误行为要件的判断可以引入物有所值评价。另外,行政决策失误责任追究需要遵循三个原则:法定原则、权责一致原则与程序正义原则。

Based on the Urban Governance Theory, PPP model realizes muhiple subject participation in urban governance, solving the ＂Public Tragedy＂ phenomenon effectively. Administrative decision-making error accountability exists in administration where the administrative subject exercises its authority in PPP model. Administrative decision-making errors assessment shall include： administrative decision-making error conduct, heavy loss result and causality. When judging the administrative decision is error or not, it should obey three principles： legal principle, the equality of right and responsibility, procedure public.
