论劝返措施在我国境外追逃工作中的运用——以“猎狐”专项行动为视角

Application of Measures of Persuading to Return in Chinese Overseas Manhunt——Taking “Fox Hunt” in China as View

作为一项重要的境外追逃手段,劝返措施在2014年7月开始的"猎狐"专项行动中大量运用。尽管目前对于劝返措施的定位在学术研究中仍存在争议,但基于政策因素、国际合作因素、经济因素等原因考量,劝返具有十分明显的优势,我国公安机关与司法机关在境外追逃追赃中大量运用。与此同时,劝返措施自身存在的局限性也应引起足够的重视。因此,一方面,我国公安机关应该会同其他机关不断完善劝返措施,促进其法治化进程,并推动其他相关境外追逃手段的完善;另一方面,加强我国法制建设、加强反外逃制度建设,更应成为我国打击犯罪嫌疑人外逃的基本措施。

As an important means of overseas manhunt,the measures of persuading to return are applied in great quantities in the＂Fox Hunt＂which began in July,2014. Although there remains controversial about the positioning of the measure of persuading to return in academic research,it is widely used by Chinese public security organs and judicial organs for overseas manhunt and money hunt and it is obviously advantageous considering the factors on policy,international cooperation and economy. Meanwhile,the limits of this measure should be paid sufficient attention. Therefore,on one hand,the public security organs in our country should perfect the measure of persuading to return with other organs and promote the process of the rule of law as well as other relevant overseas hunting means; on the other hand,to strengthen the construction of the legal system in our country and the construction of anti-flight system should be the basic measures to crack down the fleeing of the suspects.
