农村社会管理法治化模式创新研究——以闽北“约法治村”为例

Study on the Innovation of Rural Social Administrative Legalization ——A Case Study of Fujian Province “Provisional Constitution Village”

农村社会是中国社会的基础,加强社会管理的重点应在农村,而农村社会管理法治化是创新农村社会管理的必由之路。党的十八大明确提出"社会管理法治化"建设目标,研究对农村的社会管理法治化模式进行考察探究,并以闽北"约法治村"为例,对其"约法治村"的运行机制进行剖析,阐释了约法治村的概论及其模式的优越性,论证了法治在农村社会管理中的作用,指出了农村社会管理法治化进程中存在的主要问题和成因,并有针对性的提出了农村社会管理法治化实践路径的对策建议。

Rural society is the foundation of Chinese society. The work of social management should focus on strengthening the rural areas management, and rural social management legalization is the only way of social management innovation in rural areas. The goal of building ＂legalization of social management＂ was mentioned in the Eighteenth General Assembly on behalf of the Chinese Communist Party. This paper makes an investigation to explore the mode of legalized social management, analyzes the ＂village about the rule of law＂ in northern Fujian, discusses the operational mechanism, generality, as well as superiority and model of the ＂village about the rule of law＂, to demonstrate the role of legalize social management in rural area, and points out the main problems and the causes in the process of legalize social management in rural. Finally, it puts forward some suggestions to legalize the rural practice in the target of social management.
