摘要
2014—2015年,在不断涌现的新的案例以及判决等的推动下,韩国海商法发生了多方面的一系列发展,明确了以下问题:光船租赁登记情况下,船舶优先权的产生及适用范围都取决于船旗国的法律;韩国的强制性法律只有在合同中仅涉韩国因素时才能被适用,不适用于含有外国准据法条款的合同;还款保函是一种"不可撤销的和无条件的"保函。然而,对于还款保函所牵扯到的买方权利滥用问题仍然存有争议。同时,韩国根据"世越号"事件颁布了新的特别法并修订船舶安全相关法令,并确定海事法院将于2017年成立。
There were a series of developments in the field of maritime law in Korea during 2014—2015 driven by emerging cases and their decisions. The following issues have been clarified: The identification and application of the maritime lien under the bareboat charterparty depends on the law of flag state; the compulsory Korean law should be applied only when there are solely Korean factors involved in the contract and there shall not be a choice of law clause stipulating foreign laws; a refund guarantee is an"irrevocable and unconditional"guarantee. However,the problem relating to the abuse of buyer's right in the refund guarantee is still controversial. Meanwhile,Korea enacted a new special law according to "Sewol Accident"and amended relevant ship safety-related acts,and decided to establish the maritime court in 2017.
