南海海事安全国际合作的困境与出路

Dilemma and way out of the international cooperation in maritime security in the South China Sea

维护南海海事安全需要有效的国际合作,现行南海海事安全保障机制存在局限性,世界强权在海事安全国际合作旗号下介入南海问题,形成对中国南海主权的压制和威胁,超越了海事安全国际合作的边界,加剧了南海海事安全国际合作有效实施的困难。作为解决南海海事安全国际合作困境的出路,可以借助国际海事组织这一专门性海事安全管理组织的威望和海事履约体制,以履行国际海事组织现有的技术规范为根据,在南海断续线内设置安全地带制度、分航道航行制、海上避航区等制度,就此开展海事执法国际合作,并把发挥国际海事组织的作用作为中国南海战略的一个支撑策略。

An effective international cooperation is essential to maintaining the marine safety of the South China. The existing legal system of the international cooperation for the marine safety in the South China is limited. The superpowers＇ involvement in the name of the marine security international cooperation,are a big threat to the sovereignty of the South China Sea and increase the difficulty of China＇s maintenance of marine security in the South China Sea and the establishment of an effective marine safety mechanism with ASEAN. IMO should play the key role in the safety of maritime affairs and perform the marine safety standards as set by IMO such as intermittent line setting up the Safety Zone System,Traffic Separation Scheme,Area to be Avoided and other systems in the South China Sea. We can use these systems as the basis for carrying out international cooperation in international maritime law enforcement and a way to protect the South China Sea marine security. Meanwhile we should treat IMO as a support of China＇s South China Sea strategy.
