产学研协同创新中高校知识产权归属问题研究

产学研协同创新中知识产权归属影响对现代科技发展的多方面都有深刻的影响,其归属问题影响各个合作者的信心与热情。解决归属问题是当前社会发展的重要任务,其对制度与管理提出了更高的要求。文章运用比较分析法、调查研究法,对比国内外现行的知识产权归属法律制度,分类归纳现行的各种法律制度。总结出我国知识产权归属的现状、问题与原因,并从立法、国家财政性资金、职务发明、高校科研管理制度四方面提出相应的处理意见,促进知识产权归属制度的建立需要从国家立法、企业发展与高校管理三个方面共同努力,方可更好地进行协同创新。

In industry-university-research institute（IUR） collaborative innovation, the ownership of intellectual property had great effect on the development of modern science and technology in many aspects, also on all cooperators’ confidence and enthusiasm. Therefore, dealing with the problem of intellectual property ownership is the main task in the current development of society, putting forward higher requirements for the system and management. The author uses comparative analysis and investigation research to compare and classify the present legal systems about ownership of intellectual property at home and abroad, summarizing the current situation, problems and causes of ownership of intellectual property in China, proposing some suggestions to deal with the problems from such aspects as legislation, National fiscal funds, on-duty invention, scientific research management system in colleges and universities. The result is that construction of ownership system of intellectual property needs making joint efforts of national legislation, enterprise development, management in colleges and universities, and then collaborative innovation can be done well.
