阐述了加拿大体育纠纷ADR的途径,总结其特点,找出其存在的问题:体育纠纷解决体系层次复杂,职能不清;法院对体育纠纷的管辖范围模糊;内部纠纷解决机制缺乏监督;保密性和决策体系之间易冲突;仲裁裁决不许上诉不妥等。并在此基础上对我国体育纠纷ADR机制进行制度设计。

The paper researches the ADR mechanism of sports disputes in Canada.The paper introduces the ADR ways of sports disputes and analyses its features and problems.The sports dispute solving system is complicated and its function is not clear.The scope of sports disputes in the charge of court is not clear.There is conflicts between confidentiality and decision making system.Its not appropriate that Arbitration does not allow appeal.The paper designs the ADR system of the sports disputes so as to provide references for improving the sports dispute solving system in China.
