大学生受教育权与高校教育管理权冲突研究

Research on Conflicts between Undergraduate Student Rights to Education and University Rights to Education Management

大学生与高校之间教育纠纷时常发生,其深层次原因在于大学生受教育权与高校教育管理权发生冲突。两种权力(权利)法律性质和权源不同,大学生受教育权是公民基本权利,高校教育管理权兼具公权和私权性质,作为公权力的教育管理权具有扩张性,时常对学生受教育权形成威胁,最终表现为权力(权利)冲突。两种权力(权利)冲突原因不仅在于权力(权利)性质不同,还在于权利主体价值追求差异、高校管理方式不当和管理制度瑕疵等。解决权利冲突的途径在于采取利益衡平、权利通约和高校教育管理的法治化。

At present,education disputes are frequently happened between undergraduate student and their university. The deep reasons of this dispute are the conflict between undergraduate student and university rights to education management. Conflicts between university and students are caused by many factors. On the basis of analyzing the origin of undergraduate student rights to education and university rights to education management,this paper presents some reasons and resolutions of these conflicts between the above mentioned sides.
