环境污染致人身损害的致害因素及其损害后果具有一定的特殊性，环境污染致人身损害案件的处理也具有一定的难度。污染物进入环境，致使环境质量下降，后又影响到必须依赖一定质量的环境才能生存的人的生存，导致人的健康权．乃至生命权遭受不同程度侵害。对环境污染致人身损害行为人实施必要的处罚，给予受害者及时的法律救济是维护社会秩序。缓解社会矛盾，从根本上改善生态环境的关键机制，体现了法律保障人权、维护公平正义的价值取向。通过阐述环境污染致人身损害司法鉴定的法理依据、法律医学属性，司法鉴定的主体选择，司法鉴定应关注的六个问题等，以期能为环境污染致人身损害司法鉴定工作提供参考。

The factors and consequences of human injury caused by environmental pollution have certain particularities, and thus is difficult to deal with. The contaminant, when circulating into environment, will pollute the environment and affect the survival of people, resulting in infringement of people＇s right to health, even to life to a varying degree. Proper penalty to such environment polluting infringers and timely judicial remedy to the victims are critical to maintain social order, relieve social conflict and fundamentally improve the ecological environment. It also reflects the law＇s value of protecting human rights and maintaining social justice. This paper elaborates jurisprudential basis, legal medicine attributes, subject selection and six relevant issues in forensic appraisal of human injury caused by environmental pollution. It is expected to provide reference for the forensic appraisal in this field.
