摘要
历时超过五年谈成的TPP劳动章除遵循2007年美国两党协议达成的新贸易政策外,还充分回应了2015年美国的《贸易政策议程》与《贸易促进法》对劳动标准问题的关注。TPP的劳动标准内容呈现"体系性扩张"、"突出特别关注的区域和事项"、"应予内化的劳动标准之扩容"、"国别实施计划双边化与早期化"、"制裁机制更为严格"等七方面特点。基于中国对TPP倡议所持的开放态度,作为发展中国家,中国有必要首先借鉴越南、马来西亚和文莱等国家的谈判经验,在厘清不同的TPP劳动标准条款对中国的可接受性的基础上,强化共识,锁定严重分歧的仲裁和制裁领域,通过"穿靴戴帽",争取进一步的弱化。
TPP is finally concluded after over five years' negotiation. It is not only based on the Bipartisan Agreement on Trade Policy, but also fully responds to the U.S Trade Policy Agenda 2015 and Trade Promotion Act 2015. New features of labor standard in TPP include the expansion of linkage field, specific concerns on forced labor and free trade zones, the expansion of domestic adoption of international recognized labor standard, early bilateral consistency plan, stricter sanction rules, etc. China is open to TPP initiative from the very beginning of its negotiation. As a developing country, China needs first to learn the experiences of negotiation from Vietnam, Malaysia, and Brunei, and then clarifies the respective acceptance of different clauses. Based on this, it is suggested to strengthen the consensus between China and the contracting parties, focus on the critical divergence on arbitration and sanction, and try to further weaken the strict requirements by imposing relevant conditions.
