摘要
《刑事诉讼法》对隐匿身份侦查的规定过于抽象,这与隐匿侦查自身的特点及依法治国背景下犯罪嫌疑人权利保障的要求存在相当距离。为实现刑事诉讼打击犯罪和保障人权双重价值目标,隐匿身份侦查制度应当在实施主体、适用范围、审批程序以及监督救济制度等方面,进一步优化与完善。
Excessive abstraction of the provisions of the hidden identity investigationin Criminal Procedural Law is far from the hidden investigation characteristics and the requirement for the criminals＇ rights protection under the background of managing state affairs in conformity with legal provision. In order to realize the double objectives of criminal action against crimes and human rights protection, efforts should be made to further optimize and improve the hidden identity investigation system in terms of executive subjects, scope of application,approval procedures, supervision and relief system.
