支配权视角下的商标侵权混淆可能性研究

A Research on the Possibility of Confusion in Trademark Infringement in the Perspective of Desposition

以商标权的基本属性、特别是以商标权的支配性为视角,有助于明确商标侵权的本质是对商标权支配效力的损害,进而得出混淆可能性是商标支配性遭受损害的主要表现形式及判断依据的结论。在此基础上,通过对混淆可能性与商标权保护范围及商标支配权的关系进行分析,可以为我国商标法依照商品及商标的不同近似程度适用不同的混淆可能性要求的相关规定提供理论依据,并对实践中存在有关混淆可能性与商标近似性判断的关系等问题做出解答。

To look at the problem in the perspective of trademark＇s basic properties, especially the desposition nature of trademark, can help to clarify that the nature of trademark infringement is the damage to the effectiveness of desposition by trademark right, whereby the paper concludes that the possibility of confusion is not only the major manifestation but also the judgment basis in determining damages to trademark＇s desposition. Based on the conclusion, the paper analyzes the relationships between the possibility of confusion and the protection scope of trademark as well as trademark＇s desposition, in the hope of providing theoretical basis for China＇s Trademark Law to stipulate different requirement for possibility of confusion according to different degrees of similarity between commodities and trademarks. Meanwhile, the paper wishes to reply the practical question as how to determine the relationship between the possibility of confusion and the judgment of trademark similarity.
