摘要
大陆《精神卫生法》的制定是为了保障精神障碍患者的权益,是人权法治原则在精神卫生领域的体现。台湾地区的有关规定彰显了对精神障碍患者个人权利尊重和保护的价值取向。在对大陆《精神卫生法》与台湾地区的有关规定从立法宗旨、主要内容等进行比较的基础上,建议借鉴台湾地区的具体措施,细化精神障碍患者的各项权益保护规定,构建多元的照护体系,进一步明晰法律责任规定,以促进精神障碍患者的权益保护以及精神卫生事业的完善和发展。
The "Mental Health Law" aiming to promote the rights and interests of the patients with mental disorders is the embodiment of the principles of human rights and the rule of law in the field of mental health in China's Mainland. In Taiwan, the relevant provisions highlight the value orientation of protecting individual rights. Through a comparison on legislative purpose and main contents of the "Mental Health Law" in China's Mainland and relevant provisions in Taiwan, some suggestions learning from Taiwan were made, which included refining the provisions of protection of patients with mental disorders, constructing diversified care system and further clarifying the legal liability provisions in order to promote the protection of rights and interests of patients with mental disorders and the development of mental health in China's Mainland.
