Public opinion,as a public consciousness and a mapping of social existence,has a double influence on the conviction and sentencing. It not only improves the judicial transparency,but also caused many concerns because of the problem of ＂ trial by media＂. From the perspective of meaning and characteristics of public opinion,the paper discussed the pros and cons of public opinion on the conviction and sentencing and how to offset the negative effect of recommendations.
