既判力的基准时与重复起诉的识别

The Reference of Res Judicata and the Identification of Repeated Prosecution——Based on the Analysis of A Case

确定判决具有既判力,当事人不得再以同一诉讼标的和事实理由进行起诉,否则就违反既判力的要求,构成重复起诉。而后诉是否构成重复起诉要以前诉判决既判力基准时之前的诉讼内容为依据,如果就基准时以前的诉讼内容再次起诉就是重复起诉,法院将不予受理或驳回起诉。

Final judgment has res judicata,the parties may not be sued in the same object of litigation and facts,otherwise it violates the requirements of res judicata,which constitutes repeated prosecution. However,whether the latter suit constitutes repeated prosecution is based on the content of the former in the reference of res judicata,if the contents of the previous proceedings in the reference of res judicata is to repeat the prosecution,the court will not accept or dismiss the prosecution.
