论北魏的婚姻法律制度

Theory of Marriage Legal System of North Wei Dynasty

北魏是由少数民族拓跋鲜卑族建立的一个北方政权,在中国历史的发展过程中起到了承上启下的作用。它不仅集中总结了秦、汉、晋以来婚姻法律制度的成果,对其精华兼收并蓄,取精用宏,还结合自己的习惯法对婚姻法律制度进行了某些创新,为后世封建朝代和现代社会婚姻法律制度的发展和完善提供了重要依据。论文以北魏的婚姻法律制度作为研究视角,运用文献分析法和历史分析法对其进行研究,阐述北魏婚姻法律制度的形成发展过程、特点和历史地位,尤其是对其具有民族特色的婚姻法律制度进行论述,从而引发完善现代婚姻立法的思考。

As a continuity point,Northern Wei Dynasty,established by a minority named Xianbeinationality,plays an important role in the development of Chinese history,especially for the development of law. Based on the development of marriage law system in Qin,Han,and Jin Dynasty,the Northern Wei Dynasty develops and innovates its own custom in marriage,which provides a significant basis for further development of marriage law in the future. The paper is conducted in the perspective of marriage law in Northern Wei Dynasty,using the method of literature analysis and historical analysis. And this paper aims at exploring the process of the formation and development of marriage law in Northern Wei Dynasty,thereby to attract people＇s attention in the development of marriage law. Then the author tries to find out the referential value fromit,hoping to give some help for the optimization of the marriage law in modern times.
