Police Power Execution in the Scope of Rule of Law

在法治社会里,需要对公共权力进行监督与制约,公民权利需要得到尊重和保护。警察权作为公共权力,在一个社会中的运作状态往往是这个社会法治程度的象征。在现实生活中,社会公众期待稳定的社会秩序,需要警察权保护公民的权利。与此同时,强大的警察权超出必要的限度容易侵害公民的权利。在法治社会下,应当明确警察权的行使原则,合理规范警察权,把握警察权的行使界限,适当扩展公民权,实现符合法治要求和社会愿望的警察权与公民权利之间的平衡与和谐。

Public power needs supervision and restriction while civil rights require respect and protection in a society ruled by law. As a public power, the operation condition of police power in the society is often regarded as a symbol of degree of government by law. In real life, the public expect a stable social order, seeking civil rights protection from police power. Meanwhile, strong police power will encroach on civil rights if exceeding a certain limit. The execution principles of police power shall be defined in the society with rule of law to reasonably specify police power, control the execution limit of police power, properly extend civil rights and realize the balance and harmony between police power and civil rights which meets legal requirements and social desirability.
