摘要
目前,我国在校大学生利用课余时间在校外从事有报酬的隶属性兼职劳动的情形逐渐增多,伴随而来的是其劳动权益受侵害的事件也不断出现。文章从分析在校大学生校外隶属性兼职劳动的现状入手,梳理了我国相关的劳动立法规范,分析了大学生在校外隶属性兼职劳动权益应纳入劳动法保护范畴的理由;基于在校大学生身份的特殊性,建议通过在适用劳动法的社会保险方面可适当调整、制定在校大学生劳动协议示范文本并推广使用以及高校设立专门的大学生兼职管理部门等途径来保护其劳动权益。
At present in our country,there is an increase in the number of college students who spend their spare time in doing the off-campus jobs with pay and the subordination of part-time labor,and with it comes an increase of infringement of their labor rights. This article,starting from the analysis of the current situation of college students off-campus part-time labor subordination,combed the related labor legislation in our country,analyzed the reasons for the fact that college students outside school subordinate part-time labor rights should be within the protection of the labor law. Apart from this,and based on the particularity of college student identity,the article suggested that the applicable laws of social insurance be appropriately adjusted,demonstrative text for employment agreement of college students be drafted and applied,and a specialized college part-time management section be set up,so as to protect their labor rights and interests.
