Study on the Legal Effect of Citizens Participating in Legislation in China

参与立法是我国公民的一项权利。为了克服我国公民参与立法的法律效力发挥的各种障碍,必须明确其参与立法这一权利的性质,深入分析其参与立法的法律地位,并在此基础上确定立法法律关系各方主体所享有的权利(立法主体为权力)和承担的义务。切实保障公民参与立法权利的实现,同时也能保证立法民主性、科学性的落实。

Participating in legislation is a right of citizens in our country. There are obstacles in playing the legal effect of citizens participating in legislation of our country,which leads to the citizens' indifference to the right. In order to overcome the obstacles,it is necessary to make the nature of the right clear to citizens,analyze the legal status of citizens participating in legislation,and determine the rights( powers) and obligations of the citizens and the legislature. This can effectively guarantee the realization of citizens participating in legislation,and the implementation of the democratic and scientific legislation.
